ARTICLE 2 – DEFINITIONS

For the purposes of this Agreement, the following terms shall have the meanings set forth below:

MINISTER: Minister of Trade
MINISTRY: Ministry of Trade
LAW: Law No. 6502 on the Protection of Consumers
REGULATION: Regulation on Distance Contracts published in the Official Gazette dated November 27, 2014 and numbered 29188
SERVICE: Any kind of consumer transaction other than the supply of goods, performed or promised in exchange for a fee or benefit
SELLER: The company offering goods to the consumer in the course of its commercial or professional activities, or acting on behalf or account of the one offering goods
BUYER: A natural or legal person acquiring, using, or benefiting from goods or services for non-commercial or non-professional purposes
SITE: The internet website owned by the SELLER
ORDERING PARTY: The natural or legal person placing an order through the SELLER’s website
PARTIES: SELLER and BUYER
CONTRACT: This Distance Sales Agreement executed between the SELLER and the BUYER
GOODS/PRODUCT: Movable property subject to purchase and all intangible goods prepared for use in electronic form such as software, audio, video, etc.

ARTICLE 3 – SUBJECT

This Agreement governs the rights and obligations of the Parties pursuant to the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts regarding the sale and delivery of the product(s) ordered electronically by the BUYER from the SELLER’s website, the characteristics and sale price of which are specified below.

Prices listed and announced on the website are the sales prices. The announced prices and promises remain valid until updated or changed. Prices announced for a limited period remain valid until the expiration of the stated period.

ARTICLE 7 – PRODUCT(S) INFORMATION

7.1. The basic characteristics (type, quantity, brand/model, color, unit) of the goods or services are available on the SELLER’s website. In the case of promotional campaigns, product characteristics can be reviewed during the campaign period. The campaign is valid until the specified end date.

7.2. Prices
Prices listed and announced on the website are sales prices, including applicable taxes. Prices and offers remain valid until updated or changed. Limited-time offers are valid until the end of the specified period.

7.3. Taxes and Payments
The total sales price of the product(s), including all taxes, is as follows:

Invoice Delivery: The invoice will be delivered together with the order to the billing address at the time of delivery.

ARTICLE 9 – GENERAL PROVISIONS

9.1. Acknowledgement and Acceptance
The BUYER declares that they have read, understood, and acknowledged the preliminary information regarding the product’s basic features, sales price, payment method, and delivery details on the SELLER’s website and have provided the necessary confirmation electronically.

9.2. Delivery Period
Each product covered by this contract shall be delivered within the legal maximum period of 30 days, depending on the BUYER’s location, as specified in the preliminary information section of the website.

ARTICLE 10 – RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from this agreement within 14 days from the date of delivery of the goods to themselves or to the person/organization indicated, without giving any reason and without any penalty, by notifying the SELLER.

ARTICLE 11 – PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL

Products prepared according to the BUYER’s request or clearly customized for personal use, lower parts of underwear, cosmetic items, disposable products, and similar goods are not covered by the right of withdrawal.

ARTICLE 12 – DEFAULT AND LEGAL CONSEQUENCES

If the BUYER defaults on payment made by credit card, they agree, declare, and undertake to pay interest and be liable to the bank in accordance with the credit card agreement between themselves and the relevant bank.

ARTICLE 13 – GOVERNING LAW AND JURISDICTION

In the event of any disputes arising from this agreement, complaints and objections may be submitted to the Consumer Arbitration Board or the Consumer Court located in the consumer’s place of residence or where the transaction occurred.

ARTICLE 14 – ENFORCEMENT

Upon payment of the order on the website, the BUYER shall be deemed to have accepted all terms and conditions of this Distance Sales Agreement.
